TERMS & CONDITIONS (T&C)

1. Scope

These Terms & Conditions apply to all visitors, users, and customers (“Users”) of ease.day GmbH (“We”, “Us”) and to all purchases of digital products, online courses, cohort programs, coaching services, workshops, subscriptions, and any other offerings delivered via second-nature.me or related pages.

2. Conclusion of Contract

A contract is formed when the User completes the checkout process and receives a confirmation email.
Before submitting an order, Users can review and correct input using the on-screen instructions in the checkout form.
Contracts are concluded in German or English, depending on the purchase interface.

3. Services

We offer digital educational products, online courses, cohort-based programs, consulting, workshops, coaching, and related materials.
Descriptions of services are illustrative only and not guaranteed results.

4. No Guarantees

Any examples, case studies, or testimonials serve exclusively as illustrations of what is possible.
Individual results vary and depend on personal effort, circumstances, skill, and implementation.
We do not guarantee outcomes of any kind.

5. Prices, Payments & Billing

Prices are shown on the checkout page and may include VAT depending on the User’s location.
Payment must be made at the time of purchase via the methods displayed (e.g., Stripe, PayPal).
If a payment plan is offered, all installments are part of a binding total purchase and must be paid in full.
Subscriptions (if applicable) renew automatically unless canceled in accordance with Section 10.

6. Refunds

Refund policies (if any) will be clearly stated on the specific product sales page.
If no refund policy is stated,
all sales are final.
Refund terms are further specified in our Refund & Cancellation Policy, which forms part of these T&C.

7. Delivery & Access

Digital products and online courses typically grant immediate access upon successful payment.
Cohort programs provide access to onboarding material immediately, while the main content unlocks progressively.
Live sessions occur as communicated prior to or during the cohort.
Users are responsible for ensuring stable internet access and compatible devices.

8. Withdrawal Rights (EU / Germany)

For digital content provided immediately after purchase, Users expressly agree that the right of withdrawal expires at the moment access is granted (§ 356 Abs. 5 BGB).
For services such as cohort programs or coaching, Users expressly request that the service begin before the withdrawal period ends and acknowledge that the right of withdrawal expires once the service has begun (§ 356 Abs. 4 BGB).
We will obtain this confirmation during checkout (e.g., via checkbox).

9. Intellectual Property

All materials (videos, PDFs, frameworks, templates, software, presentations, recordings, etc.) remain our intellectual property.
Users receive a personal, non-exclusive, non-transferable license for private use.
Sharing, distributing, publishing, reselling, or making materials publicly available is prohibited.

10. User Obligations

Users must:

  • Keep login credentials confidential

  • Use the product only for their personal purposes

  • Respect community guidelines (if applicable)

  • Not engage in fraud or payment disputes while still having access to content

We may suspend or terminate access in cases of misuse.

11. Subscriptions & Payment Plans

Subscriptions may be canceled at any time to prevent future billing. Past charges are not refunded.
Payment plans (installments) are not subscriptions; they represent a full purchase paid over time and cannot be canceled.

12. Liability

We are liable for damages resulting from intent and gross negligence.
We are liable for injuries to life, body, or health according to statutory provisions.
For simple negligence, we are liable only for breaching essential contractual obligations (“cardinal duties”), and only to the extent of typical, foreseeable damages.
We are not liable for indirect or consequential damages, lost profits, or third-party failures beyond our control.

13. Dispute Resolution

We aim to resolve all issues directly via customer support.

Mandatory consumer rights remain unaffected.

14. Governing Law

These Terms & Conditions are governed by the laws of Germany.
International mandatory consumer protection rights apply regardless of this choice of law.
